A Court of Queen's Bench judge ruled in 2005 that Hudon and Stallknecht unlawfully detained an individual, failed to read the individualÕs rights and conducted an illegal search of the vehicle during a 2004 arrest. The judge ruled that the individualÕs Charter rights had been breached by this conduct, and that the evidence seized be excluded.
